What is the NYS Agency Disclosure Form?
Here’s what the New York State Division of Licensing Services has to say:
“THIS IS NOT A CONTRACT - New York State law requires real estate licenses who are acting as agents of buyers or sellers of property to advise the potential buyers or sellers with whom they work of the nature of their agency relationship and the rights and obligations it creates.”
There are 5 different agency relationship disclosures. As a buyer, you will, of course, be reading and signing the Disclosure Form as the Buyer, so the Buyer’s Agent section is the one you will be discussing with your agent. This is the only agency relationship that is completely dedicated to you as the buyer with no other potential conflicts. When you sign the form, you are signing that you have received a copy of the form, so if you haven’t, ask for it.
When you sign this form, you are not creating any kind of exclusive arrangement with the agent. You are just indicating that, at a minimum, the agent has given you a copy of the disclosure form. However, you are agreeing that you understand the disclosure and the obligations of the buyers agent.
The agent will keep the signed form and submit it to their broker when a purchase is made.
